Compliance and Enforcement

Overview

Tsawwassen First Nation has a Regulatory Compliance and Enforcement team whose primary role is to ensure TFN Regulations and policies are adhered to by all who reside or do business on TFN Lands. The Regulatory Compliance and Enforcement Officers work with the various groups within the TFN Government and the Delta Police Department to ensure compliance with all Laws, Regulations and policies. A TFN Compliance and Enforcement Officer is recognizable to community members by their distinct uniform consisting of a black polo shirt with the TFN logo and beige cargo pants. TFN Officers drive vehicles marked with the Tsawwassen First Nation name and logo.

Who to call – TFN Compliance and Enforcement OR Delta Police?

The lists below identify the types of issues that should be referred to TFN’s Compliance and Enforcement team and those that should be directed to the Delta Police Department (DPD).

If you wish to report a concern related to violence, criminal activity, or individual or public safety, please contact 9-1-1 immediately. If you have a police-related concern which is non-urgent in nature, please call the DPD non-emergency phone number: 604-946-4411.

Paying a Ticket

All ticket penalties can be paid directly to Tsawwassen First Nation by cash or cheque. Cash must be paid in person at the TFN Lands Department between 8:30 AM – 4:30 PM on regular business days. PLEASE do not send cash in the mail. Cheques are payable to “Tsawwassen First Nation” and can be mailed to the TFN Lands Department located at 2460 Falcon Way, Tsawwassen, BC, V4M 4G4.

Ticket payments must include a copy of the front page of the ticket or a note including the ticket number, the recipient’s full name and address, the date of issue, and the regulation and section contravened.

If a ticket is paid early (before 14 calendar days have passed from the issue date), then the penalty owed will be discounted. However, if a ticket is paid late (after 29 calendar days have passed from the issue date), a late fee will be charged in addition to the full ticket amount. Disputing a Ticket

Please refer to the back of the ticket for the procedure to follow if you wish to dispute a ticket. NOTE: Any ticket dispute must be made within 14 calendar days of the ticket issue date.

The appeal process varies depending on the type of contravention:

  1. Offence tickets may be disputed within 14 calendar days of receipt of the ticket to the B.C. Provincial Court in accordance with the procedures set out in the Offence Act (B.C.).
  2. Contravention tickets may be disputed within 14 calendar days of receipt of the ticket by filing a Notice of Claim in writing to the TFN Judicial Council. The Notice of Claim must provide an address for the person disputing the allegation and sufficient information to identify the ticket and the alleged contravention.
  3. Compliance notices may be disputed within 14 calendar days of receipt of the compliance notice by delivering a Notice of Claim to the TFN Lands Department or appearing in person at the TFN Lands Department to give notice of dispute. The notice must provide an address for the person disputing the allegation and sufficient information to identify the ticket and the alleged contravention.

There is no charge to file an initial compliance notice dispute at the TFN Lands Department. However, if the compliance notice is confirmed by the screening officer or a compliance agreement is entered into, there is a $25 administrative fee.

For matters which are appealed to the Judicial Council, if the fine on the ticket is less than $1,000, then there is no charge to file an appeal. For tickets over $1,000, a $100 filing fee will be required to file the appeal.

For matters which must be appealed to the BC Provincial Court, filing fees will be payable to that court to commence the appeal.
