These instructions are to assist lawyers and notaries acting for purchasers or leaseholders with respect to residential leasehold interests on Tsawwassen First Nation Lands and are not intended as legal advice to any person. It is your responsibility to carefully review the terms of the underlying lease agreement and ensure the accuracy of all documentation submitted to TFN.

For those purchasers purchasing NEW strata lots from developers, please contact the applicable developer directly regarding the closing procedure.

Tsawwassen First Nation (“TFN”) will only execute documents for properties where TFN is the Registered Owner. Please check your Title Search for this information.

SUBLEASES

If you are assigning a Sublease, then TFN is not involved in the assignment, do not send sublease assignments to TFN.

DOCUMENTS TEMPLATES

Only use the form of Assignment or Tripartite which is scheduled to the Lease Agreement applicable to your property.  Each Lease Agreement can be obtained directly from the Land Title Office.

Please note that properties in the same development can have different forms of agreements scheduled. ONLY use the form attached to the lease agreement applicable to your property pursuant to the title search.

It is your responsibility to ensure that the documents are in registrable form. Please note that TFN will execute documents in counterparts and only electronic documents are returned after signing by TFN unless specifically requested.

Attach a title search along with the documents you are requesting to be signed (Assignment of Lease, Tripartite, Title Search) and inform our staff if there are any special requirements. Do not send additional documents (i.e. ground leases) unless specifically requested by TFN staff. If the title search does not show the parties on the tripartite agreement, please also send the lease assignment as supporting evidence.

COPIES OF FILED DOCUMENTS

Please note that it is a term of most of the lease agreements that TFN is sent copies of the fully signed and filed (if applicable) documentation within a reasonable period of time and that your clients will use such documents strictly in compliance with the provisions of the Prohibition on the Purchase of Residential Property by Non-Canadians Act.

REGULAR TIMING

We require five (5) clear business days to obtain the required signature on the Assignment of Lease and/or the Tripartite Agreement document. A fee plus GST, per document, is applicable. A rush fee applies if you require documents in less than 3 clear business days.

It is your responsibility to ensure that TFN is in receipt of the correct closing documents and payments. Our office hours are from 8:30 AM to 4:30 PM weekdays. Any documents received after 4:00 PM shall be deemed to be received by TFN on the following business day. TFN offices are closed all Saturdays and Sundays, all statutory holidays, National Indigenous Peoples Day, National Day of Truth and Reconciliation and for two weeks at the end of December.

TFN is not responsible for any delays in the return of documents signed by TFN.

FEES

Our current administrative fee structure is below. All administrative charges are subject to change without notice and will be updated accordingly. Following receipt of the document(s) and review, we will issue a fee slip setting out any required fees in connection with the execution of the document(s).

Payment can be made online by credit card or via cash or cheque after a fee slip is issued.

Cheques can be paid in person, mailed, or couriered to: Tsawwassen First Nation, Lands Building which is located at 2460 Falcon Way, Tsawwassen, BC, V4M 4G4. Our Lands Building customer service desk is open Monday to Friday, 8:30 AM to 4:30 PM. Any payments received after 4:00 PM shall be deemed to be received by TFN on the following business day. TFN offices are closed all Saturdays and Sundays, all statutory holidays, National Indigenous Peoples Day, National Day of Truth and Reconciliation and last two weeks of December.

TAX CERTIFICATE

If a tax certificate is required for your closing, requests should be made to LTSA directly. The tax certificate can be ordered online at https://help.ltsa.ca/myltsa-enterprise/tax-certificates
